Abstract:

ABSTRACT Currently, there are no common methods of expert examination of cases with adverse outcome. A common result is that anesthesiologists and intensivists who take part in the complex forensic medical expertise make opposite conclusions. To solve this problem, the Russian Federation of anesthesiologists and intensivists can elaborate and approve the guidelines «The expert assessment of adverse outcome of medical care in anesthesiology and critical care». These guidelines should contain the following: 1) legal regulations of the activity of the anesthesiologist and intensivist as an expert; 2) the common terms and concepts, including «a defect of the medical care», «a complication of a treatment method», «a reasonable risk of a treatment method»; 3) a detailed algorithm of the expert examination; 4) assessment criteria of the adverse outcome of medical care in anesthesiology and critical care; 5) criteria of the reasonable risk of a treatment method in anesthesiology and critical care; 6) requirements to the structure and justification of expert’s conclusions. It is expected that these recommendations will allow to provide the common assessment of professional activity of anesthesiologists and intensivists in medical cases with adverse outcome and protect them from unreasonable criminal and civil prosecution.
