On July 31, 2020, Federal Law №303-FZ «On Amendments to Certain Legislative Acts of the Russian Federation on the protection of citizens’ health from the effects of nicotine-containing products” was adopted in Russia. This law in fact equates all nicotine-containing products designed to deliver nicotine in any way (except for medicines patented in the Russian Federation), including heated tobacco systems, to conventional tobacco products. However, several challenges remain that could undermine the achievements of existing regulatory measures. How relevant is the strict legal regulation of these products? The article addresses the global experience on regulating the electronic nicotine delivery systems (ENDS), including electronic heated tobacco systems (ETHS), under the international treaty — the WHO Framework Convention on Tobacco Control (FCTC) as products that pose a threat to consumer health and global anti-tobacco policy. The requirements for the global legislative regulation of the ENDS and MPOWER measures applied to them are considered. The main aspects of legislative regulation of ENDS in Russia are presented.
